These Terms of Service ("Terms") govern your use of the Livestock Ways website, mobile app, and SMS/messaging services (together, the "Services"), operated by Qwerty Experts LLC ("Livestock Ways," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. What Livestock Ways Is (and Is Not)
Livestock Ways is an information marketplace that helps people who need livestock or horses hauled ("Shippers") connect with truckers and carriers who haul them ("Haulers"). We provide a place to post loads, find loads, post truck availability, and contact each other directly.
Important — what we do NOT do:
- We are not a freight broker. We do not arrange, negotiate, or guarantee any shipment. We do not sit in the middle of any deal.
- We never handle money for a haul. We do not hold, process, transfer, or guarantee any payment between a Shipper and a Hauler. Any rate, payment, and terms for a haul are agreed and settled directly between the Shipper and the Hauler.
- We do not verify the accuracy of user postings beyond the specific verification we describe (such as DOT/USDOT checks for Haulers). We do not guarantee any load, truck, price, animal, party, or outcome.
Any tools we provide to record an agreement or mark a payment as made are a convenience record only. They are not a contract we enforce, and they do not make us a party to your deal.
2. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Services. You agree to provide accurate information and to keep it up to date. You are responsible for activity under your account and for keeping your login secure.
Haulers must provide a valid DOT/USDOT number and may be subject to verification. Verification (a "verified" badge) indicates only that we checked certain records at a point in time; it is not a guarantee of a Hauler's conduct, safety, insurance, or reliability.
3. Subscriptions and Payment
- Browsing is free. Posting a load is free for Shippers.
- Haulers pay a subscription to contact Shippers and make offers. Subscription plans, prices, and any free trial are shown in the Services.
- Trials. Any free trial is limited to one per verified DOT/USDOT number. When a trial ends, your subscription begins and your payment method is charged unless you cancel first.
- Billing. Subscriptions renew automatically for the plan period until canceled. You authorize us (through our payment processor) to charge your payment method for the applicable fees.
- Cancellation. You may cancel at any time; your access continues until the end of the current billing period, after which it will not renew. Fees already paid are non-refundable except where required by law.
- The only payment we process is your subscription. We never process payment for a haul.
4. SMS / Text Messaging Terms
- By texting our number (for example, to post a load), you consent to receive text messages from Livestock Ways related to that request and to the Services.
- Opt out at any time by replying STOP. Reply HELP for help.
- Message frequency varies. Message and data rates may apply.
- Our automated assistant may help you post a load by text. You are responsible for the accuracy of the load details you provide and confirm.
- See our Privacy Policy for how we handle your phone number and messages. We do not share your phone number or SMS opt-in with third parties for marketing.
5. Your Responsibilities and Acceptable Use
You agree that you will:
- Post only truthful, accurate information about loads, trucks, animals, rates, and yourself.
- Comply with all applicable laws and regulations, including those governing livestock transport, animal welfare, motor carriers, licensing, and insurance.
- Deal honestly and directly with other users.
You agree that you will not:
- Post false, misleading, fraudulent, or spam content, or post loads or trucks you do not control.
- Use the Services or the SMS assistant to harass, defraud, or harm anyone, or to post on behalf of someone without their authority.
- Attempt to access another user's account, scrape the Services, or interfere with their operation.
- Use the Services for any unlawful purpose, or to arrange the transport of anything other than lawful livestock/equine freight.
We may remove content, suspend, or terminate accounts that violate these Terms or that we reasonably believe are abusive, fraudulent, or harmful — including automated or bulk misuse of the SMS assistant.
6. Dealings Between Users Are Their Own
Any agreement, communication, transport, payment, and dispute between a Shipper and a Hauler is solely between them. Livestock Ways is not a party to it, does not supervise it, and is not responsible for it. You are responsible for satisfying yourself about the other party, the load, the truck, insurance, licensing, animal welfare, and all terms before you do business. We strongly encourage you to verify the other party independently.
7. No Warranty
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any load, truck, party, price, or outcome will meet your expectations.
8. Limitation of Liability
To the fullest extent permitted by law, Livestock Ways and Qwerty Experts LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, animals, cargo, or goodwill, arising out of or relating to your use of (or inability to use) the Services, any dealing between users, or any load or transport arranged through user contact — even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve (12) months before the claim, or USD $100, whichever is greater.
Some jurisdictions do not allow certain limitations; in those places, the limitations apply to the maximum extent permitted.
9. Indemnification
You agree to indemnify and hold harmless Livestock Ways, Qwerty Experts LLC, and our officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Services, your postings, your dealings with other users, your transport of animals, or your violation of these Terms or any law.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access at any time if you violate these Terms or if we reasonably believe it is necessary to protect the Services or other users. Provisions that by their nature should survive termination (including Sections 6–9) will survive.
11. Changes to the Services and These Terms
We may change or discontinue parts of the Services at any time. We may also update these Terms from time to time; when we do, we will revise the "Last updated" date and, where appropriate, notify you. Your continued use of the Services after a change means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of the United States and of the state in which Qwerty Experts LLC is organized, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in the courts located there, unless applicable law requires otherwise.
